End User License Agreement (EULA) / Terms of Use

Welcome to Quantum Effects (the "App"), a 3D gaming experience. This End User License Agreement ("Agreement" or "Terms") is a legal agreement between you (the "End User") and Witkowski ("Developer," "we," "us," or "our"), based in Poland.

By accessing, downloading, or using the App, you agree to be bound by these Terms.

1. Developer Responsibility

Developer is solely responsible for the App, including its development, installation, distribution, use, support, and maintenance. You acknowledge that Solana Mobile Inc. and its affiliates ("Solana Mobile") are not a party to this Agreement and have no responsibility or liability for the App, its content, or any support or maintenance.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use this App. By using the App, you represent and warrant that you meet these requirements.

3. Solana Wallet Integration

Quantum Effects utilizes the Solana Mobile Wallet Adapter (MWA) for authentication and signature purposes.

You are solely responsible for the security of your wallet and private keys.
Developer does not have access to your private keys or seed phrases.
Transactions on the Solana blockchain are irreversible. Developer is not responsible for any losses incurred due to network congestion, smart contract issues, or user error.

4. License Grant

Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment purposes on a compatible device owned or controlled by you.

5. Prohibited Conduct

You agree not to:

Use the App for illegal purposes or in violation of local/international laws.
Upload/transmit viruses, malware, or content that is defamatory, obscene, or promotes hate speech/violence.
Bypass security measures or exploit game mechanics (cheating).
Infringe upon the intellectual property rights of Developer or any third party.

6. Disclaimers and Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Developer disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Developer does not warrant that the App will be error-free or uninterrupted.
Solana Mobile provides no warranties or support for the App.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEVELOPER OR SOLANA MOBILE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Developer takes sole responsibility for any claims related to the App, including product liability, property damage, personal injury, or death.

8. Indemnification

You agree to indemnify and hold harmless Developer and Solana Mobile from any claims, damages, or expenses arising from your use of the App or your violation of these Terms.

9. Payments and Refunds

If the App includes in-game purchases, transactions are processed by third-party payment processors. Developer is the "Seller of Record" and is responsible for addressing billing complaints and issuing refunds where applicable.

10. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of Poland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Poland.
